Acceptance of Terms

These Terms of Use ("Terms") are an agreement between you and Maglode ("we", "us", "our"), and govern your use of the MAGLODE application (the "Game"). By downloading, installing, or using the Game, you agree to these Terms. If you do not agree, do not use the Game and delete it from your device.

You must be old enough to agree to a contract in your jurisdiction, or have the consent of a parent or guardian who agrees to these Terms on your behalf.

License to Use

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Game on Apple devices that you own or control, for your own non-commercial entertainment.

You may not:

• Copy, sell, rent, lease, sublicense, or otherwise distribute the Game
• Reverse-engineer, decompile, or disassemble the Game, except where such restriction is prohibited by applicable law
• Remove or obscure any copyright, trademark, or other proprietary notices
• Use the Game's assets, artwork, audio, or code in any other product

Acceptable Use

The Game contains no chat, no multiplayer, no leaderboards, and no user-generated content, so there is nothing to moderate between players. You agree not to modify the Game or its save data in order to misrepresent results, and not to use the Game for any unlawful purpose.

Accounts

There is no account system. The Game requires no registration, no sign-in, and no network connection. All progress is stored locally on your device.

Virtual Items

The Game contains virtual items — ore, cargo, banked scores, crates, and rig modules. These items:

• Exist only within the Game and have no real-world value
• Cannot be purchased. The Game contains no in-app purchases and no currency of any kind that can be acquired with money
• Cannot be sold, traded, transferred, gifted, or exchanged for cash, goods, services, or anything else of value
• Confer no ownership rights — you receive only a limited licence to use them inside the Game
• May be adjusted, rebalanced, or removed in future updates as part of ongoing game design

Virtual items are provided purely for entertainment. Nothing in the Game constitutes a wager, a prize, or an opportunity to win anything of value.

Local Save Data

Your progress is written to your device only. We do not hold a copy and cannot restore it. Deleting the Game erases your progress permanently. We are not liable for loss of progress caused by deletion, device failure, device replacement, or operating-system changes.

Intellectual Property

The Game, including its code, artwork, audio, interface, text, and the MAGLODE name and marks, is owned by Maglode and protected by copyright and other intellectual property laws. These Terms grant you a licence to use the Game, not ownership of it.

Updates and Availability

We may release updates that change, add, or remove features, and may discontinue the Game at any time. We do not guarantee that the Game will remain available on the App Store, or that it will remain compatible with future versions of iOS or future devices.

Third-Party Services

The Game is distributed through the Apple App Store, and your download is subject to Apple's own terms. The Game itself embeds no third-party advertising, analytics, or attribution services.

Apple is not a party to these Terms and has no obligation to provide support for the Game. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Termination

These Terms apply until terminated. You may terminate them at any time by deleting the Game. We may terminate your licence if you materially breach these Terms. On termination, your right to use the Game ends immediately.

Disclaimer of Warranties

The Game is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or free of defects.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or lost progress, arising from your use of or inability to use the Game.

Because the Game is provided free of charge and contains no purchases, our total aggregate liability to you in connection with the Game will not exceed the greater of the amount you paid for it (which is zero) or USD 10.

Nothing in these Terms limits liability that cannot be limited under applicable law.

Governing Law and Disputes

These Terms are governed by the laws applicable to Maglode, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your place of residence apply.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above will change, and material updates will be noted in the App Store release notes for the version that introduces them. Continued use of the Game after a change means you accept the revised Terms.
